These Terms of Service ("Terms") govern your use of the website zofiaatelier.com and any purchase you make from Zofia Atelier, a brand owned and operated by Lovedink Holdings LLC ("we", "us", "our"). By accessing our site or placing an order, you agree to these Terms in full. Please read them carefully before purchasing.

2. Eligibility

By placing an order, you confirm that you are at least 18 years old (or the age of majority in your country of residence) and have the legal capacity to enter into a binding contract. If you are purchasing on behalf of a minor, you assume full responsibility for the transaction.


3. Products and Availability

We work with a global network of suppliers to offer high-quality products at competitive prices. All products are carefully inspected before shipment, and we partner only with trusted manufacturers committed to high quality standards.

We reserve the right to modify or discontinue products at any time without prior notice. All product descriptions, images, and prices are for informational purposes and may contain errors. We will notify you promptly if a product you ordered is unavailable and will offer a full refund or suitable alternative.

Product images are for illustrative purposes only, and colors may vary slightly depending on the screen used. Such variations do not constitute a defect or a reason for return.


4. Prices and Payment

All prices displayed on the website include applicable taxes where required by law. For customers in the European Union, prices include VAT at the applicable rate.

We accept the payment methods listed at checkout. All transactions are processed securely via PCI-DSS certified payment gateways. We do not store your full card details.

We reserve the right to update prices at any time. The price applicable to your order is the price confirmed at checkout. In the event of a pricing error, we will contact you before fulfilling the order.

4.1 Promotions and discounts

Where a promotional price or discount is advertised, we display the lowest price applied to the product during the 30 days prior to the promotion, in accordance with EU Directive 2019/2161 (Omnibus Directive) and applicable national implementations. Promotional codes are single-use, non-transferable, and cannot be combined unless stated otherwise.


5. Order Process and Contract Formation

Placing an order on Zofia Atelier constitutes an offer to purchase. A binding contract is formed when we send you an order confirmation email. We reserve the right to refuse or cancel any order at our discretion — for example, in cases of suspected fraud, pricing errors, or stock unavailability — and will provide a full refund if payment has already been taken.

You will receive:

  1. An order confirmation email immediately after checkout.
  2. A shipping confirmation email with your tracking number once your order is dispatched.

6. Shipping and Delivery

Orders are processed within 1–3 business days of payment confirmation (quality checks and packaging). Estimated delivery times after dispatch:

Rest of world 7–17 business days

These are estimates only and may vary due to carrier delays, public holidays, or customs processing. We are not responsible for delays caused by third-party carriers or customs authorities.

Products may ship from warehouses in Asia or within the EU, depending on stock availability at the time of your order. Where applicable, customs duties and import taxes are the responsibility of the customer unless otherwise stated at checkout.

A tracking number will be provided by email once your order has been dispatched. Free shipping is offered on qualifying orders as indicated on the site — no hidden fees will be added after checkout.

Zofia Atelier transfers responsibility for the product to the carrier upon shipment. Once delivery is confirmed by the tracking system, we are not responsible for items that are not received, stolen, or damaged after delivery. In the event of loss during transit, we will open a claim with the carrier, but we cannot guarantee an immediate refund.


7. Right of Withdrawal — EU and EEA Customers

If you are a consumer resident in the European Union or European Economic Area, you have the right to withdraw from your purchase within 14 calendar days of receiving your order, without giving any reason, in accordance with EU Directive 2011/83/EU on Consumer Rights and applicable national legislation (including Spanish Royal Legislative Decree 1/2007).

7.1 How to exercise your right of withdrawal

To exercise this right, you must notify us of your decision to withdraw before the 14-day period expires. You may use the model withdrawal form below or send any other unambiguous statement to:

7.3 Effects of withdrawal

Upon receiving your withdrawal notice, we will acknowledge it promptly. You must return the goods within 14 days of notifying us. We will issue a full refund — including any standard delivery costs paid — within 14 days of receiving the returned goods or proof of return shipment, whichever is earlier. Refunds are issued using the same payment method used for the original purchase, unless expressly agreed otherwise.

Return shipping costs: unless the product is faulty or not as described, the cost of returning items is the customer's responsibility. This will be clearly communicated at the time of the return request.

7.4 Exceptions to the right of withdrawal

The right of withdrawal does not apply to:

  • Goods made to your personal specifications or clearly personalised.
  • Sealed goods which have been unsealed after delivery and which are not suitable for return for health or hygiene reasons.

8. Returns and Refunds (Commercial Policy)

In addition to your statutory rights, we want you to be completely happy with your Zofia Atelier purchase. If your order does not meet your expectations, please contact us at info@zofiaatelier.com within 30 days of delivery. Our team will work with you to find the best possible resolution.

8.1 Faulty or incorrect items

If you receive a damaged, defective, or incorrect item, please contact us within 30 days of delivery with your order number and photographic evidence. We will arrange a replacement, store credit, or full refund at no additional cost to you, including return shipping where applicable. Please note that variations in color due to screen settings as described in Section 3 are not considered defects.

8.2 Refund processing

Once a return is approved and the item received, refunds are typically processed within 10 business days to your original payment method. Processing times may vary depending on your bank or payment provider.


9. Complaints

We aim to resolve all complaints promptly and fairly. If you are dissatisfied with any aspect of your order or our service:

  1. Contact us at info@zofiaatelier.com describing the issue clearly. We will acknowledge your complaint within 2 business days and aim to provide a full response within 14 days.
  2. If we are unable to resolve your complaint to your satisfaction, you may seek alternative dispute resolution (ADR). EU consumers may also use the European Commission's Online Dispute Resolution platform: ec.europa.eu/consumers/odr.

10. Intellectual Property

All content on this site — including but not limited to logos, text, images, graphics, product descriptions, and design — is the property of Lovedink Holdings LLC or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or exploit any content without our express written permission.


11. Accuracy of Information

We strive to ensure that all information on our site is accurate and up to date. However, we do not warrant that product descriptions, prices, or other content are error-free. If a product you purchase is not as described, your sole remedy is to return it in accordance with Section 8.


12. Limitation of Liability

To the fullest extent permitted by applicable law:

  • We are not liable for indirect, incidental, or consequential damages arising from your use of our site or products.
  • Our total liability for any claim arising from a purchase shall not exceed the amount paid by you for the relevant order.
  • Nothing in these Terms limits our liability for death, personal injury caused by negligence, fraud, or any liability that cannot be excluded by law.

EU/EEA consumers: nothing in these Terms affects your statutory consumer rights, which cannot be waived or limited by contract.


13. Advertising, Influencer Marketing and AI-Generated Content

Where Zofia Atelier engages third parties (including influencers, content creators, or brand ambassadors) to promote its products in exchange for payment, free products, or other consideration, such content will be clearly identified as commercial communication using applicable disclosures (e.g., #ad, #publi, or #publicidad in Spain) in accordance with applicable advertising standards and the guidelines of the Spanish CNMC.

Zofia Atelier may use artificially generated or AI-assisted imagery and content in its own marketing materials and product listings. Where required by applicable law, including the EU AI Act, such content will be appropriately labelled. Our own paid advertisements on platforms such as Meta and Google are identified as "Sponsored" by those platforms in accordance with their policies.

We do not endorse any third-party claims made about our products outside of our official channels.


14. Indemnification

You agree to indemnify, defend, and hold harmless Lovedink Holdings LLC and its parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, and employees from any claim or demand, including reasonable legal fees, made by any third party due to or arising out of your breach of these Terms, your violation of any law, or your infringement of any rights of a third party.


15. Modifications to the Service and Terms

We reserve the right to modify these Terms at any time. The "Last updated" date will reflect any changes. Continued use of the site after changes are posted constitutes acceptance of the updated Terms. For material changes, we will notify registered customers by email.


16. Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed severed from these Terms. Such a determination shall not affect the validity and enforceability of the remaining provisions.


17. Entire Agreement

These Terms, together with our Privacy Policy, Cookie Policy, Shipping Policy, and Refund Policy, constitute the entire agreement between you and Lovedink Holdings LLC regarding your use of this site and supersede all prior agreements, communications, and proposals, whether oral or written. Any ambiguity in the interpretation of these Terms shall not be construed against the drafting party.


18. Governing Law and Jurisdiction

These Terms are governed by the laws of the State of Wyoming, USA, subject to the following:

For EU/EEA consumers: nothing in these Terms limits your rights under the mandatory consumer protection laws of your country of habitual residence. You may bring proceedings in the courts of the EU Member State where you reside. Any choice of law clause does not deprive you of the protection afforded by provisions that cannot be derogated from by agreement under the law of your country of residence.
