4. Consumer Rights — European Union

4.1 Right of Withdrawal (14-day cooling-off period)

In accordance with Directive 2011/83/EU on Consumer Rights, as implemented in Spain by Royal Legislative Decree 1/2007 (LGDCU), consumers in the European Union have the right to withdraw from any distance purchase made through this website within 14 calendar days of the date on which the consumer or a third party designated by the consumer takes physical possession of the goods, without providing any reason and without incurring any costs other than those set out below.

How to exercise this right:

To exercise your right of withdrawal, you must notify us of your decision by means of an unequivocal statement (for example, by email to info@zofiaatelier.com) before the 14-day period expires. You may use the model withdrawal form below, but this is not mandatory.

Effects of withdrawal:

Upon receipt of your withdrawal notice, we will refund all payments received from you, including standard delivery costs (except for any additional costs resulting from your choice of a delivery method other than the least expensive standard delivery offered), without undue delay and in any event no later than 14 calendar days from the date on which we are informed of your decision to withdraw. We may withhold the refund until we have received the returned goods or until you have provided evidence of having returned the goods, whichever is earlier. You must return the goods without undue delay and in any event within 14 calendar days from the date on which you communicate your withdrawal. You bear the direct cost of returning the goods.

Exceptions to the right of withdrawal:

The right of withdrawal does not apply to goods that have been clearly personalised or made to specification, goods that have been unsealed after delivery and cannot be returned for health or hygiene reasons, or sealed audio/video recordings or software that have been unsealed after delivery.

4.2 Legal Guarantee — 2 Years

In accordance with Directive (EU) 2019/771 on contracts for the sale of goods, as implemented in Spain, consumers are entitled to a minimum 2-year legal guarantee from the date of delivery of goods. If goods are found to be non-conforming within 1 year of delivery, non-conformity is presumed to have existed at the time of delivery. Zofia Atelier will, at its discretion, repair or replace non-conforming goods, or provide a price reduction or full refund where repair or replacement is not possible or proportionate.

This legal guarantee is without prejudice to any additional commercial guarantees that may be offered and does not affect your statutory rights.

All prices displayed on this website are expressed in Euros (EUR) and include applicable Value Added Tax (VAT) where required by law for sales to consumers in the European Union.
